The return of the 90-day trial period

​Effective as of December 23, 2023, employers again enjoy increased flexibility with the reintroduction of the 90-day trial period for new employees. It’s not just good news for employers, in the past we have seen employees benefit when they are given an opportunity for roles where their skills and expertise may not meet all the criteria.

Previously only available to employers with 19 or fewer employees, talking to many of our legal clients they are welcoming the change, giving them the confidence to move faster, consider a more diverse skill set in their hires and efficiently resource up, while managing their risk and eliminating costly dismissal processes.

In our experience, it is very rare to see an employer in the legal sector utilise a dismissal under the 90-day trial period. Legal employers tend to invest in the recruitment process and train and upskill new hires when needed. Therefore, candidates shouldn't be too worried about this change.
